Terms of Service

These Terms govern your use of VINwriter, an AI-powered vehicle listing generator operated from Ottawa, Ontario, Canada. By creating an account or using the service, you agree to these Terms.

1. The service

VINwriter generates vehicle listing descriptions and feature lists using AI based on inputs you provide. We give you the tool; you decide whether to publish the output. You are responsible for the accuracy of every listing you publish to the public. For specific detail on which AI provider processes your inputs, see our Privacy Policy.

2. Accounts & access

• You must be at least 18 years old and authorized to act on your dealership's behalf.
• Keep your login credentials confidential. You are responsible for activity under your account.
• One subscription covers the seats included in your plan. Sharing seats with a different legal entity is not permitted.
• You agree to provide accurate information and keep your email current.

3. Plans, billing & trials

• Paid plans begin with a 14-day free trial. You will not be charged until day 15.
• Subscriptions renew automatically at the published price until cancelled.
• You can cancel anytime from the Billing page — you keep access until the end of the paid period.
• Refunds are provided at our discretion. Partial-month refunds are not issued; annual-plan refunds for the unused portion may be provided within the first 30 days.
• We may change prices with at least 30 days' notice before your next renewal.

4. Free plan

The free plan allows 5 lifetime listings per dealership. Once the allowance is used, the account must upgrade to a paid plan to continue generating.

5. Acceptable use

You will not:

• Use the service to generate false, misleading, or deceptive listings.
• Impersonate another dealership, misrepresent vehicles, or commit fraud.
• Attempt to reverse-engineer, scrape, or overwhelm the service.
• Resell or sublicense access to third parties outside your dealership.
• Upload content you don't have the right to use (including copyrighted logos).

We may suspend or terminate accounts that violate these rules.

6. Content ownership

• Your inputs (vehicle data, branding, notes) remain yours.
• Generated output is assigned to you — you may edit, publish, and commercialize it without attribution. Note that AI-generated text cannot receive exclusive copyright protection in many jurisdictions; another party may independently generate similar text.
• VINwriter's platform (software, brand, UI) remains our property.

7. Third-party services

VINwriter integrates with third-party services — our AI provider for listing generation, Stripe for payments, and NHTSA vPIC for VIN decoding. Your use is also subject to those providers' terms when applicable. Specific providers are named in our Privacy Policy. We are not responsible for third-party outages that affect service availability.

8. Availability & beta features

We aim for high uptime but don't guarantee any specific SLA on standard plans. Beta features are provided as-is and may change or be removed without notice.

9. Disclaimer of warranties

The service is provided "as is" and "as available". We do not warrant that generated content will be error-free, legally compliant in every jurisdiction, or fit for a particular purpose. Always verify output against your inventory records and applicable advertising laws.

10. Limitation of liability

To the maximum extent permitted by law, VINwriter's aggregate liability for any claim arising from the service is limited to the fees you paid in the twelve months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including lost sales or profits resulting from an inaccurate listing.

11. Indemnification

You agree to indemnify and hold VINwriter harmless from claims arising from your use of the service, including listings you publish, content you upload, or violations of these Terms or applicable law.

12. Termination

You can close your account at any time. We can suspend or terminate accounts for violation of these Terms, non-payment, or legal requirement. On termination, access ends but we retain the minimum data required by law (see the Privacy Policy).

13. Governing law & disputes

These Terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada. Disputes shall be brought in the courts of Ottawa, Ontario, except where local consumer-protection laws give you the right to bring claims in your home jurisdiction.

14. Changes

We may update these Terms. Material changes will be announced via email at least 30 days before taking effect. Continued use after the effective date constitutes acceptance.
